Terms of Use – Alien Data-Streaming infrastructure

Thank you for using Alien Data-Streaming infrastructure.
These Terms of Use (“Terms”) govern your use of the Alien Data-Streaming infrastructure platform (“Services”), operated by Alien Intelligence SAS (“Alien”, “we”, “us”). By accessing or using Alien Data-Streaming infrastructure, you agree to be bound by these Terms.
Please note: Alien AIRM is currently in a limited-access Beta phase. As we refine our Alien Data-Streaming Services and underlying Systems, we welcome all feedback and questions at contact@alien.club.
1. PURPOSE OF THE SERVICES
Alien Data-Streaming infrastructure enables real-time access to AI-generated outputs based on licensed data, without disclosing or transferring the underlying content. It provides a legal, traceable framework for data usage in generative AI systems, connecting:
- Content Owners, who provide data or datasets;
- AI Services, who query AI models via API to receive outputs, not source data.

2. DEFINITIONS
Alien Intelligence refers to the company providing the Services. Alien Intelligence may also be referred to as “we” or “us”. Alien Intelligence is a French simplified joint-stock company (SAS) with a registered office at 78 rue de Provence, 75009 Paris, France, registered at Paris RCS under number 92055067000037.
Alien Data-Streaming Services (the “Services”) refer to the proprietary infrastructure developed by Alien Intelligence that enables AI services to interact via API to receive Generated Output derived from specific data sets that remain undisclosed by us. The Services are designed to (i) allow real-time control over Content uploaded by Content Owners and its transformation into streamable assets, (ii) enable API-based access to Generated Output for AI Services, (iii) ensure tracking and observability of usage, and (iv) support licensing and compliance with applicable intellectual property and personality rights regulations.
AI Services are third-party businesses, organizations, or individuals who access and use the Services and their Generated Output for their own applications, products, or services, whether for commercial or non-commercial purposes.
Content means any information, data, text, documents, or other intellectual property provided by a Content Owner for inclusion in Alien Data-Streaming Services, as well as datasets made available through recognized Open Source licenses. Content is never shared in its raw form with third parties.
Content Attribution refers to the process of attributing the Generated Output to one or more content sources, along with the identification of the corresponding Content Owners.
Content Owner refers to the individual or entity that provides Content to the Services, and retains all intellectual property in such Content.
Content Streaming refers to real-time generation of Generated Output in response to a particular query, with a pay-per-query model.
Generated Output means any AI-generated content produced by the Services in response to API queries, which is derived from underlying Content.
RAG System means a retrieval-augmented generation system that utilizes Content as part of its knowledge base to enhance the quality, accuracy, and relevance of Generated Output in response to user queries.
Service Users means any individual or entity using the Services to generate responses via API or interface access.
Confidential Information includes all sensitive, proprietary, or non-public information exchanged between parties under an expectation of confidentiality, such as business, financial, technical, or legal data.
3. ACCOUNT AND RESPONSIBILITIES
You must register to use Alien Data-Streaming infrastructure as either:
- Content Owner: You create and manage datasets that are made available for Data-streaming.
- AI Service: You access Generated Output through API in response to your queries.
You are responsible for maintaining the accuracy of the information and content you upload or process, and for making sure your account remains confidential.
4. CONTENT AND LICENSING
By uploading Content to the Services, you:
- Retain full ownership and intellectual property rights over the Content;
- Authorize Alien Intelligence to process the Content to operate the Services to deliver Generated Output via API;
- You acknowledge that Alien may process your Content by transforming it into individual words chunks, vector embeddings, tags, or metadata-level elements, which may be stored independently of the original dataset. Usage data related to your activity on the platform may also be collected and processed only for the purpose of Providing the Services. For more details on how we handle personal data, please refer to our Privacy Policy;
- Authorize Alien to sub-license Generated Output to AI Service Providers in accordance with the applicable Alien Licensing Agreement.
- Acknowledge that use of the Services by AI Services requires Content Attribution.
The full legal terms governing these uses are set forth in a separate Alien Licensing Agreement, which defines the scope of processing for providing the Services and output sub-licensing. By continuing to use the Services, you agree to the terms of that Licensing Agreement.
Until a generic user-facing permissions interface is deployed, we operate on a case-by-case basis. This means:
- You may withdraw or modify your authorization at any time, subject to reasonable operational constraints.
Beta phase: During this Beta phase, we are actively tailoring the product and licensing framework with our selected users. If you wish to ask for a custom license setup, or restrict certain uses of your Content, please contact us directly at contact@alien.club or select “custom license” in our Services interface. Our goal is to give you maximum control over how your data is used.
Also, please note that currently, the ‘Data licensing’ option which allows an AI Service to acquire data to train its model (and therefore NOT data-stream) is available on an opt-in basis in our interface, if you select ‘Allow training’ for your Content Dataset. Please refer to the Licensing Agreement.
User Content Compliance
You agree to upload, transmit, or otherwise use only content for which you hold all necessary rights and authorizations to use within the scope of the Services.
Content must not:
- infringe upon any third-party rights, including intellectual property rights (such as copyrights, trademarks, design rights), moral rights, rights of publicity, or privacy rights;
- contain any personal data without a valid legal basis, nor any sensitive or health-related data as defined under applicable data protection laws (including the GDPR).
By using the Services, you represent and warrant that all content you provide complies with these requirements. We reserve the right to suspend or remove access to the Services in the event of any breach, without prejudice to any other remedies we may pursue.

The Alien Data-Streaming Services include access via API. Documentation for the APIs is available at: https://app.alien.club/. This documentation may be updated from time to time.
AI Service Providers agree to comply with the terms of the Sub-License available in Exhibit of the Licensing Terms, to respect the usage limitations described in the API Documentation, and to refrain from any malicious activity, attempt to circumvent technical protections, or misuse of the Services.
5. ACCEPTABLE USE
You agree not to:
- Upload any content you do not have the legal right to process or license;
- Upload or facilitate processing of illegal, defamatory, discriminatory, or misleading data;
- Use the Services for reverse engineering, extraction, or circumvention of licensing terms.

Sensitive Data Warning: While we do not technically restrict the upload of special categories of data (e.g., health), Content shall not contain any personal data without a valid legal basis, nor any sensitive or health-related data as defined under applicable data protection laws. You remain solely responsible for complying with applicable laws (e.g., GDPR, HIPAA). Please consult your legal counsel before uploading data.
6. USE OF DATA AND SERVICES IMPROVEMENT
Alien may analyze aggregated usage and metadata (e.g., most queried datasets, frequency, success rate) to improve the Services and inform Content Owners on how to improve their Content. No personal or identifying information is shared without consent. This helps Content Owners optimize their datasets and licensing potential.
7. DISCLAIMER
Alien Data-Streaming infrastructure is currently offered in a limited-access beta mode to selected partners. As such, features, stability, and performance may vary. We appreciate your feedback and reserve the right to modify or discontinue features at any time. All feedback provided shall be free from any intellectual property rights and may be freely used, incorporated, or otherwise exploited by Alien without restriction or obligation.
8. FEES AND PAYMENT
BETA SPECIFIC: At this stage, all payments and financial flows are managed directly by Alien through third party providers such as Stripe, as described in the Documentation and the Privacy Policy. Alien is responsible for distributing any amounts due to Content Owners or collected from AI Service Providers as contractually agreed.
9. CONFIDENTIALITY/DATA PROTECTION
- All parties agree to keep confidential information disclosed via the platform secure and not use it beyond the permitted scope.

10. TERM AND TERMINATION
We may suspend or terminate your access to the Services at any time:
- If you breach these Terms or a Streaming Contract;
- To comply with legal obligations;
- With prior notice, if the beta program ends or services change.
You may terminate at any time, but remain bound by outstanding obligations.
11. DISCLAIMER/LIMITATION OF LIABILITY
Alien Data-Streaming infrastructure is provided “as is” with no warranties of uninterrupted service or fitness for a particular purpose.
To the extent permitted by law, Alien disclaims all indirect liability and limits total liability to the amount paid by you in the previous 12 months.
12. MARKETING AND PUBLICITY
Each party has the right to use the other Parties' trademark(s) for Content Attribution (please set up your Company’s information with care in the Services), and for all communications related to the Services of this Licensing Agreement, in accordance with the guidelines provided by the trademark owner.
13. GOVERNING LAW
These Terms are governed by French law. Any disputes shall fall under the exclusive jurisdiction of the Paris courts.

We may update these Terms from time to time. Material changes will be communicated via the Data-Streaming infrastructure interface and to your preferred contact email. Continued use after such notice constitutes acceptance.
